This bill seeks to clarify the rules for out-of-state billing related to certain disability waiver services in Minnesota. Specifically, it directs the Commissioner of Human Services to submit proposed amendments to the Centers for Medicare and Medicaid Services (CMS) by December 1, 2025. These amendments would update home and community-based services (HCBS) waiver plans to allow individualized home supports without training, respite, and night supervision to be considered direct care staff services. This change would permit these services to be authorized and provided to waiver participants who are either temporarily traveling out of state or attending an out-of-state postsecondary school.
